Questions we are asked
My H-1B received a Request for Evidence. Is the petition lost?
No. An RFE is a request, not a denial, and most are answerable. What matters is the response: it must address the exact regulatory element the officer questioned, with documentary evidence rather than argument alone. We regularly take over cases at the RFE stage.
Do I need an advanced degree for a National Interest Waiver?
An advanced degree is one qualifying route, but exceptional ability supported by experience, salary, publications or industry recognition can also qualify. The harder question is the national-importance and benefit analysis, which is where most NIW petitions are won or lost.
Can my company sponsor a green card while I am on an H-1B?
Yes, and in most cases it should start early. PERM and I-140 processing runs on its own timeline, independent of your H-1B validity, and beginning the process before your sixth year protects your ability to extend past it.
